BLACKRIDE CAR SERVICES

1. GENERAL PROVISIONS

This Agreement (“Contract”) is entered into between Blackride Car Services, LLC, located at 13520 Small Mouth Way, Riverview, Florida (USA) (“Blackridecity”), and the individual or entity (“User”) who utilizes Blackridecity’s transportation arrangement services. Blackridecity operates as a transportation service facilitator via its proprietary online platform, including third-party integrations and mobile applications (collectively, “BR Tools”).

Blackridecity does not provide transportation services but arranges service contracts between Users and independent ride service providers (“Transportation Providers” or “TPs”). This Contract governs the rights and obligations of Users when engaging Blackridecity for the arrangement of transportation services. Any conflicting terms and conditions proposed by the User are expressly rejected unless agreed to in writing by Blackridecity.

2. CONTRACTUAL RELATIONSHIP AND CONTRACT CONCLUSION

2.1 Contractual Relationship

Blackridecity does not act as a transportation provider or an agent for third-party transport services. Instead, Blackridecity facilitates a direct claim for transport services between the User and the independent TP (“contract for the benefit of third parties”).

Blackridecity enters into agreements with TPs to grant Users direct claims for transport services. Users may request and enforce transportation services directly with the TP. This Contract solely pertains to the arrangement of transportation services, not the actual transportation. Blackridecity’s compensation includes an arrangement fee and the payment to the TP for services rendered.

2.2 Contract Conclusion

A transportation arrangement contract is concluded when a User submits a ride request via BR Tools or telephone. Blackridecity will acknowledge receipt via email. A subsequent booking confirmation email finalizes the Contract, establishing the User’s direct right to transportation from the TP.

3. USER REGISTRATION REQUIREMENT

Users must provide accurate and complete registration information. Automated registrations are prohibited.

4. TRANSPORTATION SERVICE CONDITIONS

4.1 Ride Types and Service Modifications

Users may select from the following ride types, subject to local availability:

  • Transfer rides
  • Long-distance rides (50+ miles)
  • On-demand rides (“chauffeur hailing”)
  • Hourly bookings

Service modifications after booking are subject to availability and may incur additional charges.

4.2 Pickup Time Adjustments

Pickup times are confirmed at booking. If Users provide flight or train details, pickup times may adjust for delays.

4.3 Vehicle Selection and Upgrades

Users select a vehicle class (e.g., Prime Sedan, Prime SUV, First Class, Sprinter Van, Stretch Limo). Specific vehicle models are not guaranteed. Blackridecity may upgrade the vehicle class at no extra charge, subject to availability.

4.4 Transport Safety Regulations

4.4.1 Luggage and Animals

Users must declare excess/bulky luggage, weapons, or animals during booking. TPs may refuse transport if prior arrangements are not made. Additional charges may apply.

4.4.2 Transport of Children and Minors

Users must request child restraints in advance. TPs may refuse unaccompanied minors per legal requirements.

4.4.3 Passenger and Luggage Limitations

Passenger and luggage limits per vehicle are pre-determined. TPs may refuse transport if these limits are exceeded.

4.4.4 Impeded Transport

Failure to disclose relevant transport details may result in denied service. Users remain liable for full payment.

4.5 Delays

Users acknowledge that extraordinary events (e.g., strikes, severe weather) may result in delays or cancellations without liability on Blackridecity’s part.

5. RESERVATION, PAYMENT, CANCELLATIONS, REBOOKINGS, AND NO-SHOWS

5.1 Reservation Confirmation and Payment

  • Full payment is required at booking.
  • Priority is given to Users with completed payments.
  • Accepted payment methods: major credit/debit cards (no cash payments except for gratuities).
  • Additional charges apply for tolls, waiting time, extra stops, and unforeseen expenses.

5.2 Cancellation & No-Show Policy

5.2.1 Cancellation Policy

Sedans, SUVs, and Transit Sprinters:

  • Cancellations must be made at least 24 hours before pickup.
  • Non-refundable cancellation fees: $35 or 25% of total cost (whichever is greater) for Sedans & SUVs; $65 or 25% for Transit Sprinters.

Stretch Limousines, Party Buses, Limo Sprinters, and Buses:

  • $200 or 25% of total trip cost (whichever is greater) non-refundable cancellation fee.
  • Cancellations within 24 hours incur a 50% charge.
  • All cancellations must be submitted via BR Tools.

5.2.2 No-Show Policy

  • No-shows apply if a User is unreachable within 30 minutes of the pickup time (60 minutes for airport/train stations).
  • Free waiting time: 60 minutes (airport/train station), 15 minutes (all others).
  • Additional waiting time is charged per minute.
  • Failure to appear without notification results in full fare charge.

5.3 Reservation Changes & Rebooking

  • Changes must be requested at least 3 hours before pickup.
  • Rebookings are treated as new bookings and may incur original cancellation fees.

6. PASSENGER CONDUCT & VEHICLE POLICIES

6.1 Passengers must comply with traffic laws and TP instructions. 6.2 Smoking is prohibited. 6.3 Food consumption is discouraged; alcohol is allowed with prior approval. 6.4 Cleaning fees apply for spills, stains, or damages.

7. PAYMENT AND FEES

7.1 Pricing Structure

  • Charges are based on vehicle type, route, and additional service requests.

7.2 Ride Modifications & Additional Charges

  • Additional charges apply for extra mileage, extended time, and waiting fees.
  • Hourly bookings include a set mileage limit; excess mileage incurs additional fees.

8. LIABILITY

8.1 General Liability

  • Blackridecity is not liable for damages unless caused by gross negligence or intentional misconduct.
  • TPs and drivers are independent contractors, not Blackridecity employees.
  • Blackridecity is not responsible for lost or damaged personal belongings.

8.2 BR Tools Content Liability

  • Blackridecity does not guarantee the accuracy of BR Tools content and is not liable for errors unless caused by gross negligence or intent.
