BLACKRIDECITY TERMS AND CONDITIONS

1. GENERAL PROVISIONS

Blackride Car Services, LLC, located at 13520 Small Mouth Way, Riverview, Florida (USA) (“Blackridecity”), facilitates the booking of transportation services via its proprietary online platform, integrating third-party online platforms and mobile applications (collectively, “BR Tools”). Blackridecity arranges for the transportation of users by independent ride service providers (“Affiliates refer to Transportation Providers” or “TPs”). Blackridecity does not itself provide transportation services but arranges business service contracts between users and TPs.

These General Terms and Conditions (“T&Cs”) govern every user agreement related to Blackridecity’s service arrangements. These T&Cs also establish the user’s direct claims against a TP for transportation services. Any conflicting user terms and conditions are expressly rejected unless Blackridecity management agrees in writing.

2. CONTRACTUAL RELATIONSHIP AND CONTRACT CONCLUSION

2.1 Contractual Relationship

Blackridecity does not operate as a transportation provider or an agent for third-party transport services. It solely facilitates a user’s claim for transport services against an independent TP.

To enable this service, Blackridecity enters into necessary agreements with TPs, granting users a direct claim for transport against the TP (“contract for the benefit of third parties”). Users may request transportation services and pursue related claims directly against the TP.

Blackridecity and users only enter into contracts for the arrangement of transportation services, not for the actual transportation itself. Blackridecity’s compensation includes both the business arrangement fee and the payment to the TP for services rendered.

2.2 Contract Conclusion

A contract for transportation arrangement is concluded when a user submits a ride request via BR Tools or telephone. Initially, Blackridecity confirms receipt of the ride request via email. A separate booking confirmation email finalizes the contract, granting the user direct rights to request transportation from the TP.

3. USER REGISTRATION REQUIREMENT

Users must provide accurate and complete information when registering with Blackridecity. Automated registrations are strictly prohibited.

4. TRANSPORTATION SERVICE CONDITIONS

4.1 Ride Types and Service Modifications

Users may select from the following ride types, subject to local availability:

  • Transfer rides
  • Long-distance rides (50+ miles)
  • On-demand rides (“chauffeur hailing”)
  • Hourly bookings

Requests for service modifications after booking are subject to availability and may incur additional charges.

4.2 Pickup Time Adjustments

The agreed pickup time is stated in the booking confirmation. If the user provides flight or train details, the pickup time will adjust in case of delays.

4.3 Vehicle Selection and Upgrades

Users select a vehicle class (e.g., Prime Sedan, Prime SUV, First Class, Sprinter Van, Stretch Limo). Specific vehicle models are not guaranteed, and Blackridecity may upgrade the vehicle class at no extra charge, subject to availability.

4.4 Transport Safety Regulations

4.4.1 Luggage and Animals

Users must specify excess or bulky luggage, weapons, and animals during booking. The TP may refuse transport if prior arrangements were not made. Additional surcharges may apply.

4.4.2 Transport of Children and Minors

Users must request child restraints during booking. TPs may refuse to transport unaccompanied minors per applicable laws.

4.4.3 Passenger and Luggage Limitations

The maximum number of passengers and luggage pieces per vehicle is pre-determined. TPs may refuse transport if safety regulations are compromised.

4.4.4 Impeded Transport

Failure to communicate mandatory transport details may result in denied service, and Blackridecity may still charge for the booking.

4.5 Delays

Users acknowledge that delays due to extraordinary events (e.g., strikes, severe weather) may result in longer wait times or cancellations without liability on Blackridecity’s part.

4.6 Cancellations, Rebookings, and No-Shows

4.6.1 Cancellations

Cancellation Policy

Standard Vehicles (Sedan, SUV, Sprinter)

  • Cancellations must be made at least 24 hours before the scheduled pickup.
  • A non-refundable fee applies:
    • $30 for Prime Sedans and Prime SUVs
    • $50 for Sprinters
  • The remaining balance will be refunded as a credit.

Special Events (Concerts, Sports Games)

  • A 7-day notice is required for cancellations of Sedan, SUV, and Sprinter bookings.

Luxury & Large Vehicles (Limo Sprinter, Party Buses, Executive Vans, Minibuses)

  • Cancellations must be made at least 7 days in advance.
  • A non-refundable fee of $60 applies.

Motor Coaches

  • A 15 to 30-day cancellation notice is required.
  • A non-refundable fee of $99 applies.

International Trips

  • A minimum 72-hour cancellation notice is required or as specified in your booking confirmation.
  • Cancellation fees apply based on the terms outlined in the confirmation.

General Cancellation Guidelines

  • Cancellations must be made through the BR Tools platform.

Changes to reservations made with less than the required notice may incur additional charges up to the full fare.

4.6.2 Rebookings

Rebookings are treated as new bookings. The original booking may still incur cancellation fees.

4.6.3 No-Show Policy

If a user fails to appear within 30 minutes (or 60 minutes for airport/train station pickups) of the agreed time, the ride is deemed a no-show, and the full fare is due.

4.7 Conduct in Vehicles

Passengers must follow traffic laws and TP instructions. Smoking is prohibited. Food consumption is discouraged, and alcohol is permitted only with TP approval. Cleaning fees apply for violations.

5. PAYMENT AND FEES

5.1 Pricing Structure

The booking confirmation specifies ride charges based on vehicle type, route, and requested extras (e.g., child seats, multiple stops).

5.2 Ride Modifications

Users may request ride modifications after booking. Additional services (e.g., extra mileage or time) will be charged per applicable pricing schedules.

5.3 Additional Charges

5.3.1 Waiting Time Fees

  • 60 minutes of free waiting time for airport/train station pickups
  • 15 minutes of free waiting time for all other rides
  • Additional waiting time is billed per minute based on hourly rates

5.3.2 Excess Mileage Fees

Hourly bookings include a set mileage limit; excess mileage incurs additional fees per standard rate.

5.4 Payment Methods

Users may pay via credit card. Bank transfer transaction fees are the user’s responsibility.

5.5 Invoice Issuance and Due Dates

Invoices are available electronically in user accounts. Credit card payments are charged immediately; bank transfers must be completed within the specified invoice terms.

5.6 Vouchers

Vouchers are single-use, non-transferable, and non-redeemable for cash.

6. LIABILITY

6.1 General Liability

Blackridecity is only liable for damages resulting from intentional misconduct or gross negligence. TPs and their drivers are not agents of Blackridecity.

6.2 BR Tools Content

Blackridecity does not guarantee the accuracy or reliability of content available through BR Tools and is not liable for damages arising from errors unless caused by gross negligence or intent.
